Until further notice, the following policy will be adhered to if a continuance is necessary. If the Debtor or the Debtor's Attorney cannot attend the regularly-scheduled meeting of creditors to which they are assigned, a continuance request must be sent by FAX to the Trustee at (312) 922-8722. Your request for continuance must include a return FAX number. You will receive a new date by FAX transmission. That new date will be Trustee Ebner's next regularly scheduled meeting date. The new meeting time will be at the end of the time slot for which they were orginally scheduled. That is, if the orginal meeting was scheduled for an 11:00 AM meeting, the new meeting will be held at the end of the 11:00 AM call. If the Debtor and the Debtor's Attorney do not attend the continued meeting, the Trustee will move for a case dismissal. Although rare exceptions may apply, Will County meetings will always be held in Will County. If there are extenuating circumstances (i.e., a death in the family, hospitalization, etc.) which result in a greater than 30-day continuance, the Trustee shall require a signed stipulation consenting to an extension of the date by which the Trustee can object to the Debtor's discharge. The executed stipulation must be either received by the Trustee or filed with the Clerk of the Bankruptcy Court before the continued meeting takes place. An example stipulation is in this Word document. Copyright © 2004 Law Office of Deborah K. Ebner |
